General Terms and Conditions of Lucian Rumpe - Stills & Motion
1. Scope
These terms and conditions apply to all orders placed with Lucian Rumpe - Stills & Motion. They also apply to other similar contracts without further notice.
Differing conditions from the client or licensee will not be recognized unless Lucian Rumpe - Stills & Motion expressly agrees to their validity.
2. Commissioned productions
For commissioned productions, Lucian Rumpe - Stills & Motion creates photos and/or films for the client. Contracts for commissioned productions are concluded through an offer from Lucian Rumpe - Stills & Motion and acceptance by the client.
Lucian Rumpe - Stills & Motion selects the agreed number of the photos and/or film recordings taken at its own discretion, processes the photos and/or films as explained in the offer and leaves them to the client via data transfer or on a data medium. Delivery dates are only binding if they have been expressly agreed.
Further additional services from Lucian Rumpe - Stills & Motion such as storage or printing are agreed individually.
If the client has not given Lucian Rumpe - Stills & Motion any express instructions regarding the design of the photographs and/or film recordings, then complaints regarding the image interpretation and the artistic or technical design are excluded.
Lucian Rumpe - Stills & Motion grants the client, upon payment of the agreed remuneration, the exclusive and unrestricted rights of use of the photographs and/or films, excluding the editing rights, unless otherwise agreed.
The photographer has the unrestricted right to attribution and to use the finished photos and/or films of the order for personal portfolio use, provided this has not been excluded.
3. Compensation
To commissioned productions and the license for photographs and/or films, applies the agreed remuneration. If the booked period is exceeded for commissioned productions, Lucian Rumpe - Stills & Motion's remuneration will increase to an appropriate extent.
If Lucian Rumpe - Stills & Motion has been booked for a specific date or period and this appointment is canceled by the client less than three working days before the agreed date, 50% of the offered recording time (hours on shooting location, excluding post production) and 100% of the time of work already done will be billed.
Invoices must be paid within 14 days without deductions. Until the agreed remuneration has been paid in full, the client or licensee is not permitted to use the photos and/or films, unless otherwise agreed.
4. Liability
The client assures that when people are admitted, they have given their consent. Lucian Rumpe - Stills & Motion is liable to ensure that the licensed photos and/or films do not infringe the rights of third parties.
5. Data protection
The client's personal data required to fulfill the contract will be stored by Lucian Rumpe - Stills & Motion.
Lucian Rumpe - Stills & Motion undertakes to treat all information that becomes known to him as part of the order confidentially and not to use the recordings - except for his own use - without the consent of the client.
6. Final provisions
Unless otherwise specified in these General Terms and Conditions, changes and/or additional agreements must be made in writing to be effective. The written form requirement also applies to the waiver of this form requirement.
If one of the preceding provisions is ineffective or unenforceable, the effectiveness of the remaining provisions remains unaffected. Instead of the ineffective or unenforceable provision, a suitable, legally effective replacement provision that comes as close as possible to economic success will be made by mutual agreement. The place of jurisdiction depends on the legal provisions. The current law of the Swiss Confederation at the time of the order applies. If a provision of these General Terms and Conditions is ineffective, the validity of the remaining provisions will not be affected.
